Why the County Said No

Why Counties Reject Kit Paperwork

No Florida Product Approval

Florida requires structural products to carry a Florida Product Approval or site-specific sealed engineering. Most national kits sold at Costco, Home Depot, Lowe's, Amazon, Wayfair, and BJ's have neither — they're built for a national market, not Florida's code. Without one of the two, the reviewer has no legal basis to approve the structure.

The Manufacturer's Sheet Isn't Sealed by a Florida PE

The “engineering documentation” in the box is a generic sheet with no Florida PE signature and seal. Counties cannot accept unsealed calculations for a structure anchored to the ground. It doesn't matter how professional the sheet looks — without the seal, it's not engineering under Florida law.

No Site-Specific Wind Analysis

FBC 2023 and ASCE 7-22 wind loads depend on your address: design wind speed (130 to 180+ mph across Florida), exposure category, enclosure classification, and structure geometry. A one-size-fits-all rating can't account for any of that — the county needs calculations run for your parcel, not a national average.

Kits Are Rated for Lower Wind Speeds Than Florida Requires

Many aluminum and light-steel kits are rated for 90–120 mph — fine for most of the country, well short of Florida's requirements. The frame members are often adequate, but the factory anchorage almost never is. That gap is exactly what our reinforcement design closes.

Can I just install my pergola kit without a permit?

You can, but the risks are real: code enforcement fines that accrue daily, forced removal, denied insurance claims after a storm, and a flagged unpermitted structure at resale that appraisers value at zero. If it fails in a hurricane and damages a neighbor's property, the liability is yours. Permitting the kit properly costs far less than any of those outcomes.

My kit says it's engineered for 140 mph wind. Why isn't that enough?

Because the rating is generic and unsealed. Florida counties require engineering that applies FBC 2023 and ASCE 7-22 wind loads calculated for your exact address, exposure, and risk category — signed and sealed by a Florida licensed PE. A marketing number on a box or an unsealed spec sheet doesn't satisfy either requirement, no matter how high the number is.

Do I still need this if my HOA already approved the structure?

Yes. HOA approval and a county building permit are completely separate. The HOA reviews appearance and community rules; the county reviews structural safety under the Florida Building Code. HOA sign-off carries zero weight with the building department — you need both.

What documents do you need from me?

Three things: the kit's installation manual or spec sheets (usually a PDF from the manufacturer or retailer), your property survey showing where the structure will go, and photos of the installation area. What if I already installed it without a permit?

What if my kit can't meet Florida code at all?

Most kits can be made compliant with upgraded anchorage; a few — usually very light aluminum in high-wind coastal zones — cannot be reasonably reinforced.
